General conditions of sale

Article 1 – Modification of the general conditions

We reserve the right to modify our prices and these conditions of sale and warranty at any time and without notice.

Article 2 - Availability of products and deadlines


Upon receipt of your order, we check the availability of the product ordered.

We undertake within 10 days from validation of the order:

- to deliver the product ordered to you or to reimburse you.

 

Repair times are given for purely indicative purposes only and are not binding. Delay or failure to deliver may not under any circumstances give rise to damages or compensation of any kind.

 

In case of stock shortage on some of the items in your order. Available items will be shipped. Missing items will be refunded.

 

In the event of a stock shortage without the possibility of new supplies, your order will be cancelled and you will be refunded.

Article 3 – Order processing:


The order will be validated:

on the order date in the event of payment by credit card online or Paypal on the date the check is cashed in the event of payment by check.

Under no circumstances may the buyer claim the right to cancel an order or refuse the goods.

Your order is then reserved for 8 days. Beyond this period, without receipt of your check, it will be cancelled. The order will only be processed upon receipt of your check and after validation by our services.


Article 5 – Default of payment:


FCtronic reserves the right to refuse to make a delivery or to honor an order from a customer who has partially paid for an order.

Or would not honor payment for a previous order.

Or with whom a payment dispute is being processed.


Article 6 – Delivery:


We invite each buyer to check the goods upon receipt and make any useful reservations with La Poste if necessary.

Delivery costs are calculated based on their weight and the delivery method selected when confirming your order.

Delivery will be made by La Poste or any other transport provider. For deliveries, please check, in the presence of the delivery person, the number, condition and contents of your packages. In the event of damage, you must state the date and damage in detail and make reservations on the delivery note.

In order to assert your rights with the service provider. It will be up to the buyer to provide all justifications as to the reality of the defects or anomalies noted.

Article 7 – Retention of title clause:


The products remain the property of FCtronic until the order has been fully paid. Parts sent for repair remain the property of the customer.


Article 8 – Conditions of guarantees and responsibilities


The warranty extends to French territory and concerns repairs and equipment sold new, used and reconditioned. The equipment is guaranteed exclusively under the conditions defined in article 1643 of the Civil Code.


A-  Garantie FCtronic

 

New equipment on sale on the SAVPORTAIL.com website is guaranteed for 12 months.

 

Reconditioned equipment on sale on the SAVPORTAIL.COM website is guaranteed for 3 months.

 

In the event of a breakdown during the initial warranty period, repairs will be carried out free of charge by FCtronic.

 

Shipping costs will be your responsibility.

 

It follows that FCtronic guarantees the equipment sold against only hidden defects or a failure of said repair. The equipment is guaranteed for the period specified above from the invoice date, subject to the total effective payment of the invoiced part and the return of the old part in the case of a standard exchange.

 

To benefit from these provisions, the buyer must notify FCtronic in writing within two weeks of discovering the defects that he attributes to the equipment and provide all justifications as to the reality of these defects. The purchase invoice for the part as well as those for the assembly carried out by a professional must be provided without fail.

Failure to provide these items will void the warranty.

 

FCtronic is the only party authorized to work on the equipment unless otherwise agreed in writing.

Failure to comply with this clause will result in the loss of the warranty.

Consequently, the customer must not disassemble or open the part under any circumstances.

Failure to comply with this clause will void the warranty. Each item leaving our workshop is tested and labeled on the day of shipment. Labels must be present and intact.

 

FCtronic is the only party authorized to apply the warranty. Any return under warranty must be subject to prior agreement by FCtronic.

Any unjustified return and/or return without prior agreement from FCtronic will be subject to an invoice of thirty (30) euros including tax.

Any repair, expertise and testing of equipment not covered by this warranty may be billed to the customer.

 

The warranty ceases when the damage results from the inexperience, negligence or fault of the user during assembly, commissioning or use of the part covered by the warranty and in particular when the assembly recommendations mentioned below are not respected.

The application of the warranty does not extend its duration.

 

Repair of the part by another establishment or by yourself automatically results in definitive exclusion of the warranty.

The guarantee granted cannot give rise to any compensation or damages.

It limits the liability of FCtronic.

This warranty does not cover in any case the costs of labor, breakdown, towing, handling, transport, travel as well as costs resulting from the immobilization of an engine.

Any damage that may be caused to all or part of a motorization by a defective part is expressly excluded from the conditions of application of the warranty, and cannot give rise to any compensation of any kind. It is advisable to ensure the proper functioning of the part when installing it on the motorization.

 

Return shipping costs under warranty remain the responsibility of the customer.

 

B-Legal guarantees

 

You benefit from the provisions of the legal guarantee of conformity and the guarantee of hidden defects, provided for by the Consumer Code and the Civil Code:

Compliance :

Article L211-4 of the Consumer Code:

The seller is required to deliver goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been placed in his charge by the contract or has been carried out under his responsibility. Article L211-5 of the Consumer Code:

To comply with the contract, the good must: 1) Be suitable for the use usually expected of a similar good and, where applicable: - Correspond to the description given by the seller and possess the qualities that the latter has presented to the buyer in the form of a sample or model; - Present the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labeling; 2) Or present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted. Article L211-12 of the Consumer Code:

The action resulting from the lack of conformity is prescribed by 2 years from the delivery of the goods.

In order to benefit from this guarantee, you can contact our customer service directly by email from the SAVPORTAIL.COM website. To facilitate and speed up the process, a return number will then be assigned to you, which you should indicate when returning the product.

You will be able to choose between the replacement or the repair of the returned product. However, under Article L 211-9 of the Consumer Code, if the option you have chosen entails a disproportionate cost, we will resort to the other option. However, if no repair or replacement is possible, or if the solution you have chosen cannot be implemented within one month of your complaint, or if this solution presents a major inconvenience for you given the nature of the good and the use you are seeking, you may then request the termination of the contract. This termination will not be pronounced if the defect is minor. If the termination is pronounced, the price will be refunded to you within 15 days of receipt of your return.

 

Hidden defects:

Article 1641 of the Civil Code:

The seller is liable for the warranty against hidden defects in the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would have paid a lower price for it, if he had known of them. Article 1648, paragraph 1 of the Civil Code:

The action resulting from latent defects must be brought by the buyer within 2 years from the discovery of the defect. In order to benefit from this guarantee, you can contact our customer service directly by email from the SAVPORTAIL.COM website. To facilitate and speed up the process, a return number will then be assigned to you, which should be indicated when returning the product. A check of the fault and its origin is carried out upon receipt of your product. The returned product, if affected by a hidden defect, will be refunded including shipping costs, or exchanged according to your request and available stocks.

The photos representing our products are not contractual.

 

C- Responsibilities

 

FCtronic cannot be held responsible for the partial application of the contract concluded, due to the occurrence of a force majeure event. This force majeure event may be, depending on the circumstances, where appropriate a total or partial strike of postal services, carriers, or a disaster caused by flood or fire.

With regard to products purchased to satisfy professional needs, FCtronic shall not incur any liability for any indirect damages arising from these terms, operating losses, loss of profits, damages or costs, which may arise. The choice and purchase of a product are placed under the sole responsibility of the customer.



Article 9 – Exclusions of guarantees and responsibilities


Damage, breakdowns, faults or defects attributable to causes of external origin (incorrect application of equipment, electrical surges, damage due to insects, etc.) are not covered by the warranty.

Failures resulting from modifications to the construction and original characteristics of the device are not covered by the warranty. Failures affecting parts that do not comply with those recommended by the manufacturer are not guaranteed. Adjustments accessible to the beneficiary without dismantling the device are not guaranteed. Failure to comply with the manufacturer's instructions will void the warranty. Makeshift or temporary repairs and the consequences of any worsening of the resulting damage are not covered by the warranty. Damage due to corrosion, incorrect connection or a power supply problem (a power supply problem should be understood as not a power supply problem internal to the product, but external to it) are not covered.

It is recalled that the benefit of the guarantee does not prevent the application of the legal provisions relating to the legal guarantee of conformity and the guarantee of hidden defects (legal guarantees) reproduced below.


Article 10 – Application of the guarantee


After checking your photocells, videophone, intercom, digital code, contact button, and other possible accessories.

It is important to properly reset the electronic card without any accessories connected and to re-learn the remote controls and motor races.

If you have photocells, some modules require a bridge on the terminal blocks (see instructions).

Please note, after the workshop test by one of our technicians and no fault is found on the electronic card, a flat rate of €30 including tax will be charged for the time spent and return costs.

For warranty application, please attach a copy of the repair invoice.

The repair only concerns the electronic part of the card. Before any repair, a diagnosis is carried out using our measuring instruments and a test on real engines. If the card is not repairable, no fees will apply and you will be reimbursed for any amounts already paid. However, if you wish to recover the irreparable card, only the delivery costs will be requested (10 euros).


Article 11 – Right of withdrawal



In accordance with Article L 121-20 of the Consumer Code, you have a period of 7 clear days from receipt of the products to withdraw without reason and return the products to us. If this period expires on a Saturday, Sunday or public holiday, it is extended until the next working day. Beyond this period, no withdrawal will be accepted.

Unless expressly stated otherwise for "custom-made" or personalized Products, all our Products are subject to the right of withdrawal. You can exercise your right of withdrawal directly by email from the SAVPORTAIL.com website. To facilitate and speed up the process, a return number will then be assigned to you, which should be indicated when returning the product.

To be returned, the product must be complete, fit for resale, and returned in its original, complete packaging. You bear the cost of returning the product.

After having offered you a credit corresponding to the full price charged, and if you refuse it, we will refund the returned product by check, transfer, or re-credit, at your convenience, as soon as possible.



Article 12 – Provisions of the “data protection and freedoms” law:



At any time, "you have the right to access, modify, rectify and delete data concerning you (art 34 of the "Informatique et Libertés" law of January 6, 1978). This law governs the implementation of files or processing of personal data, whether automated or manual. You can exercise this right by email by specifying it in the contact form. The email addresses collected on the site will not be transferred to third parties.
